Terms and Conditions for Adding Your Digital Health ID Pass to a Third-Party Digital Wallet

 

These Terms and Conditions for Adding Your Digital Health ID Pass to a Third-Party Digital Wallet (the "Terms") apply when you choose to add a Zelis Digital Health ID Pass ("Digital Health ID Pass") to a digital wallet or other service managed or owned by a third party ("Wallet"). In these Terms, "you" and "your" refer to you as the plan holder of the Digital Health ID Pass, and "Zelis," “we," "us," or "our" refers to Zelis as the issuer of your Digital Health ID Pass.

By adding a Digital Health ID Pass to a Wallet, you agree to these Terms:

  1. Adding Your Digital Health ID Pass.  You can add the Digital Health ID Pass to a Wallet by following the instructions as they appear on the site of the digital Wallet application (“Wallet Application Provider”) that you are using, along with the instructions from the Zelis proprietary platform (e.g., zelis.com or redcard.com) or your health plan’s propriety platform. We note the following with regard to certain Wallet Application Providers: Apple Wallet® is a trademark of Apple Inc., registered in the U.S. and other countries and regions; and Google Wallet® is a trademark of Google LLC, registered in the U.S. and other countries and regions.  Only a Digital Health ID Pass that we determine is eligible can be added to the Wallet. If your Digital Health ID Pass or underlying account is not in good standing, that Digital Health ID Pass will not be added to the Wallet. We may determine other eligibility criteria in our sole discretion. When you add a Digital Health ID Pass to a Wallet, the Wallet may allow you to use the Digital Health ID Pass to store and display membership data of your enrolled health plan. The Wallet may not be accepted at all places where your traditional member ID is accepted. We reserve the right to terminate our participation in a Wallet or with a Wallet Application Provider at any time and the right to designate a maximum number of Digital Health ID Passes that may be added to a Wallet.
  2. Zelis Is Not Responsible for the Wallet. Zelis is not the provider of the Wallet, and we are not responsible for providing the Wallet service to you. We are only responsible for supplying information securely to the Wallet Application Provider to allow usage of the Digital Health ID Pass in the Wallet. We are not responsible for any failure of the Wallet, for any errors or delays caused by, or the inability to use, the Wallet for any specified transaction. We are not responsible for the performance or non-performance of the Wallet Application Provider or any other third parties regarding any agreement you enter into with the Wallet Application Provider or associated third-party relationships that may impact your use of the Wallet.
  3. Contacting You Electronically and/or by Email or through Your Mobile Device. You consent to receive electronic communications and disclosures from us in connection with your Digital Health ID Pass. You also agree that we can contact you by email at the email address you provide to us in connection with the Wallet, or through the mobile device on which you have downloaded the Digital Health ID Pass and the Wallet. It may include contact from your Wallet Application Provider. You agree to update your contact information with us when it changes.
  4. Removing Your Digital Health ID Pass from the Wallet. You should contact the Wallet Application Provider, or follow the instructions as they appear on the site of the Wallet Application Provider, to remove a Digital Health ID Pass from the Wallet.
  5. Governing Law and Disputes. These Terms are governed by federal law and, to the extent that state law applies, the laws of the state that apply to the Terms governing your Digital Health ID Pass. Disputes arising out of or relating to these Terms will be subject to any dispute resolution procedures applicable to your Digital Health ID Pass.
  6. Ending or Changing these Terms; Assignments. We can terminate these Terms at any time. We can also change these Terms, or add or delete any provisions in these Terms, at any time. Your use of a Digital Health ID Pass in a Wallet after we have made such changes available will be considered your agreement to such changes. We will provide notice if required by law. We can also assign these Terms. Furthermore, subject to applicable law, at any time we may (i) terminate your use of any Digital Health ID Pass in connection with your Wallet, (ii) modify or suspend your use of the Digital Health ID Pass in connection with your Wallet, (iii) change a Digital Health ID Pass' eligibility for use with a Wallet and/or (iv) change the Digital Health ID Pass authentication process. You cannot change these Terms, but you can terminate these Terms at any time by removing the Digital Health ID Pass from the Wallet. You may not assign these Terms.
  7. Privacy. Your privacy and the security of your information are important to us. Our Online Privacy Policy (available online at: https://www.zelis.com/privacy-policy/ ), as amended from time to time, applies to your use of your Digital Health ID Pass in the Wallet. You may be provided with the ability to share your Digital Health ID Pass with the Wallet Application Provider, and you agree that we may share certain of your other information with the Wallet Application Provider and others in order to provide the services you have requested, to make information available to you about your Digital Health ID Pass, and to improve our ability to offer these services. This information helps us to add your Digital Health ID Pass to the Wallet and to maintain the Wallet. We do not control the privacy and security of your information that may be held by the Wallet Application Provider and that is governed by the privacy policy given to you by the Wallet Application Provider.
  8. Notices. We can provide notices to you concerning these Terms and your use of a Digital Health ID Pass in the Wallet by posting the material on our website, through electronic notice given to any electronic mailbox we maintain for you or to any other email address or telephone number you provide to us, or by contacting you at the current address we have on file for you.   9. Limitation of Liability; No Warranties. WE ARE NOT AND SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE OR INJURY OR FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, ARISING FROM OR RELATED TO YOUR ADDING YOUR DIGITAL HEALTH ID PASSOR YOUR ACCESS OR USE OF A WALLET. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS OF ANY KIND (EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS) AS TO your digital health id pass AND/or ALL WALLETS AND ALL INFORMATION, PRODUCTS AND OTHER CONTENT INCLUDED IN OR ACCESSIBLE FROM your digital health id pass AND/or ALL WALLETS.
  10. Questions. If you have any questions, disputes, or complaints about the Wallet, contact the Wallet Application Provider using the information given to you by the Wallet Application Provider. If your question, dispute, or complaint is about your Digital Health ID Pass, then contact us at: DigitalHealthIDPass@zelis.com
